Vol. 15 No. 3

CEISTEANNA—QUESTIONS. ORAL ANSWERS. - DECREES FOR LAND ANNUITIES (CO. DONEGAL).

asked the Minister for Lands and Agriculture if application was made (Receivable Order 80/5783, folio 8399, Estate of Mrs. Margaret V. McSheffrey) to Patrick McLaughlin, Henry, Drumaville, parish of Malin, Rural District Inishowen, Co. Donegal, for 18/6 by Mr. W.T. McMenamin, State Solicitor; whether he is aware that this sum has been already paid to the Sheriff's bailiff on face of a decree, and a receipt in respect to same was signed by Mr. Francis Fallon on the 15th December, 1925.

Inquiries are being made in the matter referred to, but as these are not yet completed I would ask the Deputy to have the question repeated next week.

asked the Minister for Lands and Agriculture if he is aware that an application was made to Hugh and Ellen McLaughlin (Receivable Order 2395/66 and 80/10148, Estate of G. L. Young, Townland Glengad, Inishowen Rural District, Co. Donegal), for £4 6s. 0d., the amount of a decree for a Land Commission instalment or annuity, by Mr. W.T. McMenamin, State Solicitor, on March 8th, 1926; that this sum was previously remitted from Culdaff, Co. Donegal, by Money Order on 22nd December, 1925, accompanied by Receivable Order, to Mr. McMenamin, and addressed to his office at Ballybofey, and that Mr. McMenamin has not replied to several communications addressed to him by the persons mentioned on the subject of this payment.

The amount due on foot of the decree was remitted to the Land Commission on 28th February, 1926, by the State Solicitor, who reports that the demand referred to in the question was issued from his office through inadvertence. He further states that he received no communication from the tenant calling attention to the error.

asked the Minister for Lands and Agriculture if he is aware that an application was made to Mary Kelly (Receivable Order 2395/91 and 80/10147, Estate of G. L. Young, Townland Glengad, Inishowen Rural District, Co. Donegal), for £6 9s. 7d., amount of a decree for Land Commission instalment or annuity, by Mr. W.T. McMenamin, State Solicitor, on March 8th, 1926; that £5 10s. 1d. of this sum was previously remitted from Culdaff, Co. Donegal, by Money Order on January 4th, 1926, accompanied by Receivable Order, to Mr. McMenamin, and addressed to his office at Ballybofey, and that Mr. McMenamin has not replied to several communications addressed to him by Mrs. Kelly on the subject of this payment.

The payment of £5 10s. 1d. was remitted by the State Solicitor to the Land Commission on 1st March, 1926, and placed to the tenant's credit. The State Solicitor states that the defaulter has not paid the costs and that the application referred to in the question was intended to extract the costs. The State Solicitor states that he received no communication in reply to the demand.
