CEISTEANNA—QUESTIONS. ORAL ANSWERS. - INCOME TAX COLLECTOR'S CLAIMS.

asked the Minister for Finance if he is aware that a decree was granted by the late Recorder at Kanturk in June, 1920, for a sum of about £80 in respect of the destruction of income tax books; that the then income tax collector, Mr. John O'Driscoll, applied for this money to the Revenue Commissioners, and, if so. whether he is in a position to say when this money will be paid.

An award was made as stated, but as this claim and a number of similar claims arose out of raids on income tax offices in which the Government was interested, they were of the nature of Government Department claims and did not fall for review in the ordinary course by the Compensation (Ireland) Commission. Consequently the award usual in cases of pre-Truce damage to property was not made by the Commission in the present instance, but the question of discharging this and other claims of like character is at present under consideration, and it is hoped that the matter will be disposed of at an early date.

asked the Minister for Finance if he is aware that Mr. John O'Driscoll, Clonbanin, Banteer, late income tax collector, has repeatedly applied for payment of arrears of salary amounting to £490 claimed to be due to him, and, if so, whether he can say when this sum will be paid.

The terms of appointment of a Collector of Taxes provide that payment of the whole of the remuneration attaching to his Collection is conditional upon the work being performed in a satisfactory manner, and on the accounts being closed by delivery of final schedules and payment of all outstanding balances of tax being made on or before the prescribed dates. On Mr. O'Driscoll's resignation as Collector of Taxes in 1923, considerable arrears of tax remained over to be collected by his successors. He has been paid the full remuneration warranted by the work which he performed, and out of the amount withheld from him must be provided payment for his successors on completion by them of the work of collection.
