PUBLIC SAFETY (EMERGENCY POWERS) BILL, 1926. - PUBLIC SAFETY (EMERGENCY POWERS) BILL, 1926—THIRD STAGE.

Before this Bill is passed I desire to say I want to have my name recorded against it. I am not going to allow myself the displeasure of having it charged against me that I have handed over powers against the people to an Executive without the checks which the Constitution or the law should provide. The President talked about only dealing with what is probable in a Bill of this kind, and that we must leave out of account what is possible. I am afraid that that idea has rather obsessed the minds of Ministers in their proposed legislation. When you are handing over powers to any authority I think you have got to take into account the possibilities as well as the probabilities, and, in this case, I think we are handing over to the Executive too many powers over the individual citizen. We are frustrating the purposes of the Constitution and we are making legal protection practically of no effect, and I am going to have my vote recorded against the passing of this Bill.
