asked the Minister for Lands and Agriculture whether the Irish Land Commission have received particulars from John J. Macken, Esq., solicitor, Mullingar, in respect of Thos. Berry, of Crieve, Streamstown, Westmeath (a tenant of the owners of the Crieve estate), who held under a fee farm grant a farm of about 97 statute acres, at a rent of £50, to the effect that the said tenant has come to an agreement with the owners that his future rent will be £36, to enable him to purchase under the Land Act, 1923; and, if so, whether a receivable order has been sent to Mr. Berry, and how soon the Land Commission expect to be in a position to vest his holding.

It was only on the 16th instant that an application was lodged on behalf of Thomas Berry, the proprietor of a parcel of land held by him under a fee farm grant for an advance under the provisions of Section 38 of the Land Act, 1923, for the purpose of redeeming the rent payable under the grant.

It is now the duty of the proprietor to apply to the Judicial Commissioner in the manner prescribed by the Rules of the Land Commission for an order for the redemption of the rent, and on the steps prescribed by the Rules as to title, etc., being complied with the advance will be made. Until this has been done the purchase annuity on the advance will not begin to run, and in the meantime the proprietor is liable for the rent as heretofore.
