Vol. 19 No. 25

CEISTEANNA—QUESTIONS. ORAL ANSWERS. - KILDARE COMPENSATION AWARD.

asked the Minister for Finance whether he will state the reasons for the delay in paying £2,500 compensation to Mr. James Fagan, of Ryebrook, Leixlip, Co. Kildare, granted by Judge Dromgoole in June, 1922, for the destruction of his house, and whether he will expedite payment to Mr. Fagan, who intends to expend the whole amount granted on the reconstruction of his premises as soon as possible.

This decree was reopened under Section 2 (3) of the Damage to Property (Compensation) Act, 1923, and on rehearing an award of £2,500 was made. £300 of this amount was, I understand, in respect of the clearance of debris and the reconstruction of portion of the injured premises by the applicant, and this part of the award, with £116 8s. 3d. in respect of costs and expenses, was paid in November, 1925. The balance, £2,200, is subject to a full reinstatement condition, and can be paid only according as reinstatement is carried out. The applicant's solicitor was informed on 7th November, 1925, of the steps necessary to secure payment, but, as far as I am aware, no effort has yet been made to comply with the condition attached to the award.
