Vol. 25 No. 1

CEISTEANNA—QUESTIONS. ORAL ANSWERS. - CLAIMS OF DISMISSED RAILWAYMEN.

asked the Minister for Industry and Commerce whether he can state when a new arbitrator will be appointed to hear the claims of railwaymen dismissed under the Railway Acts, 1924-26; whether he is aware that the claims of some of these men are over three years awaiting a hearing; whether he can state when Judge Davitt will sign the requisite orders of cases heard last September; and whether he is aware that an appeal cannot be lodged until these orders are signed, and that the delay in signing is holding up test cases.

As I have stated in reply to previous questions on this subject, the appointment of an arbitrator, should a vacancy arise, is solely a matter for the Chief Justice, and I have no authority to interfere.

I understand that it is hoped to have all the awards, in the cases already heard, issued during or shortly after the present legal term. The award in what is being regarded as the "test case" is receiving special attention so as to expedite an appeal if it is intended to proceed with it.

Is the Minister aware that these Acts do not appear to be administered in accordance with the promises made by Deputy Peadar Doyle to his constituents, and will the Minister take the necessary steps to see that Deputy Doyle's promises are fulfilled?
