Vol. 28 No. 4

Ceisteanna—Questions. Oral Answers. - Supreme Court Judgments.

asked the Minister for Justice whether he will give a list of all Supreme Court judgments that have been reserved for three months or longer, and the date the hearing was concluded in each case.

The following is a list of the cases in which judgment has been reserved by the Supreme Court for a period of three months and upwards and has not yet been delivered. There are three such cases: 1, the case of Gaussen v. Ellis, of which the hearing was concluded on the 13th February, 1928. 2, the case of Devoy v. Hanlon, of which the hearing was concluded on the 1st March, 1928; and, 3, the case of Rattigan v. Regan, of which the hearing was concluded on the 22nd October, 1928.

Can the Minister give any indication as to when judgment will be delivered?

Of course, that is a matter solely within the discretion of the Court, but I should say that these two cases of Devoy and Hanlon—that is the second case —and Rattigan v. Regan, and the other case, all hang together. Devoy and Hanlon raised a very important question under the Local Registration of Title Act. Two other questions also came up for decision, and the Court held over judgment in Devoy and Hanlon until Rattigan and Regan and the third case could be argued. The third case has been argued, and I understand judgment in the whole three cases will very shortly be delivered.
