Gárda Síochána Pensions Order, 1930.

I beg to move:—

"Go gceaduíonn an Dáil leis seo an tOrdú um Pinsin an Ghárda Síochána, 1930, a dhein an tAire Dlí agus Cirt an 30adh lá de Mheitheamh, 1930, le cead an Aire Airgid, fé Alt 13 d'Acht Có-nasctha na bhFórsaí Póilíneachta, 1925, agus a leagadh ar Bhord na Dála an 19adh lá de Mhí na Samhna, 1930."

"That the Dáil hereby approves of the Gárda Síochána Pensions Order, 1930, made on the 30th day of June, 1930, by the Minister for Justice, with the sanction of the Minister for Finance, under Section 13 of the Police Forces Amalgamation Act, 1925, and laid on the Table of the Dáil on the 19th day of November, 1930."

The only thing which is new in this Order is No. 3. When members who had resigned or had been dismissed from the D.M.P. were reinstated in the D.M.P., they were allowed to date their service, for the purpose of pensions, back to the date of their original entry into the D.M.P. A similar provision did not exist for resigned or dismissed members of the D.M.P. who, instead of rejoining that force, joined the Gárda Síochána. The purpose of this Order is to put resigned or dismissed members of the D.M.P. who joined the Gárda Síochána on the same footing as regards pensions as those others who rejoined the D.M.P. Section 4 simply makes clear the expression "annual pay" in the existing Order. Some doubt existed as to what it was, but this makes it clear that "annual pay" means annual pay without reduction. There is no change in practice. It is simply carrying on the practice, but making it clear that the practice was right. The only other provision enables the Minister for Finance, when a person entitled to a pension is suffering from mental disability, to pay the pension to somebody for the benefit of that person.

Perhaps the Minister will mention in how many cases he expects the first clause of the Order will apply?

Not more than three or four at the outside.
