Ceisteanna—Questions. Oral Answers. - Land Commission and Limerick Road.

asked the Minister for Lands and Fisheries whether he is aware (a) that a number of years ago officials from the Land Commission mapped out a road which was to be constructed through the O'Mahony Estate, Mountcollins, Abbeyfeale, Co. Limerick; and if he is aware that only a small portion of the road was constructed; (b) whether he is aware that one of the tenants on the estate (John Doherty) only agreed to a temporary right of way through his land on the strict understanding that the aforementioned road would be completed by the Land Commission; and (c) whether he will state if the Land Commission are prepared to give effect to the undertaking given; and, if so, if he will state the date upon which the work will be commenced.

The holding of John Doherty in the townland of Mountcollins on the estate of D. R. Mahony was vested in him on the 26th November, 1925, subject to a permanent right of way reserved for the use of other tenants in the townland in accordance with the terms of the purchase agreement signed by him. No undertaking was given by the Land Commission that they would construct a road on this passway, but they have already received applications for the improvement of this passway from the tenants using it. As the Deputy has already been informed, the Land Commission contemplate the migration of one or more tenants from this townland if untenanted land becomes available for that purpose, and they have, therefore, postponed the consideration of the said applications until it has been decided whether any migrations can be effected, as it may be possible on the division of the vacated holdings to provide a shorter passway to the holdings of these tenants.
