Vol. 41 No. 4

Ceisteanna—Questions. Oral Answers. - Railway Arbitration.

asked the Minister for Industry and Commerce if he will state what is the present position regarding the arbitrator under the Railways (Existing Officers and Servants) Act, 1926, and whether any steps can be taken to expedite the hearing of cases pending.

I understand the arbitrator is not in a position to deal with the claims which have been submitted to him pending the hearing of a case in the High Courts brought by the Great Southern Railways Company to determine the precise extent of his powers. Further progress must depend on the conclusion of that case.

Can the Minister say if there is an arbitrator taking on these cases as they arise?

The Attorney-General, who was arbitrator under this Act, has tendered his resignation to the Chief Justice, but the Chief Justice has asked him to withhold it until this case has been determined.

Does the Minister intend to appoint a substitute for the Attorney-General?
