Resolution No. 25—Stamp Duty.

(1) That there shall be charged in respect of the available surplus within the meaning of Sections 5 and 6 of the Public Charitable Hospitals (Amendment) Act, 1931 (No. 24 of 1931), in every sweepstake which is held under the Public Charitable Hospitals (Temporary Provisions) Act, 1930 (No. 12 of 1930), and in which the drawing or any of the drawings of prizes is made after the 1st day of March, 1932, a stamp duty at the rate of twenty-five per cent. of the amount of such available surplus.
(2) That the duty mentioned in this Resolution shall be deducted from the available surplus in respect of which it is chargeable and shall be so deducted by the committee appointed under Section 2 of the Public Charitable Hospitals (Temporary Provisions) Act, 1930, for the purposes of the sweepstake in which such available surplus arises and shall be paid to the Revenue Commissioners by such committee.
(3) That
(a) the reference in sub-sections (3) and (4) of Section 5 of the Public Charitable Hospitals (Amendment) Act, 1931, to two-thirds of the available surplus in a sweepstake shall be construed as referring to two-thirds of the balance of such available surplus remaining after deduction of the duty mentioned in this Resolution, and
(b) the reference in Section 6 of the said Act to one-third of the available surplus in a sweepstake shall be construed as referring to one-third of the balance of such available surplus remaining after deduction of the duty mentioned in this Resolution.

I move amendment No. 30:

In paragraph (1), page 27, to delete all from the word "rate" in line 8 to the end of the paragraph and substitute the words "following rates, that is to say:—

(a) in the case of any such sweepstake in which the drawing or all the drawings of prizes is completed before the 6th day of April, 1932, at the rate of seventeen and one-half per cent. of the amount of the said available surplus in such sweepstake, and

(3) in the case of every other such sweepstake, at the rate of twenty-five per cent. of the amount of the said available surplus in such sweepstake."

The purpose of this amendment is to levy stamp duty at the rate of 3/6 in the £ in respect of sweepstakes, the drawing of prizes for which was completed before the 6th day of April 1932.
