Harbours (Regulation of Rates) Bill, 1933—From the Seanad.

It is proposed to ask the Dáil to agree to all the amendments coming from the Seanad. They are in accordance with certain suggestions made by members of the Opposition and, therefore, I take it that there will not be any objection if we deal with them now. The purpose of all the amendments is to provide that where it is intended to make a Harbour Rates Order, an Order varying harbour rates, notice shall be given to the harbour authorities and they shall be required to publish the intention to make such an Order.

The following amendments were agreed to:—

1. Section 3, sub-section (3). The words "has made or" deleted in line 5.

2. Section 5, sub-section (1). The words "has made or" deleted in line 37.

3. Section 5, sub-section (1) After the word "order" in line 38 the words "the Minister shall give notice to" inserted.

4. Section 5, sub-section (1). The words "order or" deleted in line 39.

5. Section 5, sub-section (1). After the word "relates" in line 39 the words "and such harbour authority" inserted.

6. Section 5, sub-section (1). The words "order or" and also the words "as the case may be" deleted in line 42.

7. Section 5, sub-section (2). The words "if the Minister so directs" deleted in line 44.

8. Section 5, sub-section (2). The word "order" where it first occurs, and also the words "or application," deleted in line 48.

9. Section 5. A new sub-section added at the end of the section as follows:—

(6) Whenever a harbour authority fails to publish any notice directed by the Minister to be published by them under this section or to comply with any other direction given to them by the Minister under this section, the Minister may, without prejudice to any other proceedings against such harbour authority, himself publish such notice or carry out and execute such direction and all expenses incurred by the Minister in so doing shall be borne by such harbour authority and such expenses shall be recoverable by the Minister from such harbour authority as a simple contract debt in any court of competent jurisdiction.

Agreement with Seanad amendments reported; the Seanad to be notified accordingly.
