Vol. 61 No. 8

Ceisteanna—Questions. Oral Answers. - Clare Farmer's Right of Way.

Mr. Hogan

(Clare) asked the Minister for Lands if he will state what is the cause of the failure of the Irish Land Commission to provide a right of way to his farm for John Neylon, Ballyduffmore, Kilnamona, County Clare (Receivable Order No. 385-47).

Proceedings for the provision of a right of way for John Neylon across the holding of John Power were instituted under Section 43, Land Act, 1923, and Section 39, Land Act, 1931. Objections to the proposed right of way were made by the parties concerned at various stages of the proceedings, and the Land Commission are at present in course of making a fresh order under the sections cited, providing the right of way.

Mr. Hogan

Is the Parliamentary Secretary not aware that this man, though in possession for the last three or four years, is suffering considerable loss because he cannot take his milk to the creamery, for instance?

I am personally aware of the fact that proceedings have been going on for a long time, but at last I can assure the Deputy that the matter is almost concluded, or will be concluded very soon.
