Vol. 67 No. 6

Ceisteanna—Questions. Oral Answers. - Town Tenants' Tribunal's Terms of Reference.

asked the Minister for Justice if the terms of reference of the Town Tenants' Tribunal include cases of injustice, hardship, or abuse arising under Part V of the Landlord and Tenant Act, 1931, as between ground landlords and building lessees on renewal of expiring leases.

The Town Tenants' Tribunal was set up in pursuance of a resolution passed by the Oireachtas, in which the terms of reference were specifically set out. These terms of reference are as follows:—

"To inquire into, report to, and make recommendations to the Minister for Justice upon the following matter, that is to say:—

"(a) whether any, and if so, what, hardships and abuses arise or are capable of arising under the existing law governing the letting on occupation tenancies at occupation rents of houses and parts of houses in cities, towns and villages where the house or the part so let is used by the occupier thereof wholly or party as a dwelling-house, and

"(b) if any hardships or abuses are found to arise or to be capable of arising, what additions to or amendments of the said existing law are practicable and desirable to remove or modify such hardships and abuses or to prevent the same from arising."

Perhaps the Minister would now answer the question, whether the terms of reference of the tribunal include the cases referred to in the question?

I have given the terms of reference.

Will the Minister say whether these cases are included or not within the terms of reference? That is the question put to the Minister.

Let the Deputy read it himself.
