Ceisteanna—Questions. Oral Answers. - Fines on Publicans.

asked the Minister for Justice if he will state in respect of each of the years 1939, 1940, 1941 and 1942 (1) the number of cases in which fines imposed on publicans under the Intoxicating Liquor Acts were (a) wholly, (b) in part, remitted by him; (2) the number of fines imposed under the Intoxicating Liquor Acts on persons frequenting licensed premises which were (a) wholly, and (b) in part, remitted by him; and further, whether he will state (a) the normal procedure in connection with the remission of penalties under the Intoxicating Liquor Acts, and (b) the number of cases in each of the years mentioned in which that procedure was departed from.

The total number of cases under all heads mentioned in the question, during the entire period mentioned, was 22. In two of these cases, the entire penalty was remitted. Fuller particulars will appear in the Official Report. The usual procedure is that the view of the justice who imposed the fine is obtained before the case is submitted to the Minister. That was not done in two cases.
