Ceisteanna—Questions. Oral Answers. - Missing Bicycle.

asked the Minister for Justice if a bicycle was reported to the Gárdaí by a Miss Partridge in January, 1942, as having been lost or stolen at Sion Hill, Blackrock; if the said bicycle was subsequently recovered by the Gárdaí, and if he will state whether the bicycle has been restored to Miss Partridge; and, if not, what steps are being taken to restore her property.

Miss Partridge reported the loss of a bicycle as suggested in the first part of the question. She gave a full description, including the manufacturer's number, and subsequently produced the receipt as to its purchase. The Gárdaí subsequently found a bicycle bearing that number and corresponding in every detail with the description given by Miss Partridge. Miss Partridge positively indentified the bicycle as the one stolen from her. The person found in possession of the bicycle stated that she had bought it from a third party, whom she named. The third party was charged with stealing the bicycle and other charges arising out of the same circumstances. When the case was heard in the District Court the justice dismissed these charges and refused an application for an order that the bicycle should be returned to Miss Partridge.

I am advised that there is nothing which the Gárdaí or the Department can do further to assist Miss Partridge, but that it may be open to her to proceed by way of a civil action.

Is not the Minister satisfied that the bicycle in question was the property of Miss Partridge?
