asked the Minister for Industry and Commerce if he is aware that the Trade Union Tribunal has given the Building Workers' Union the sole right to organise bricklayers and stonelayers; if he is further aware that the trade union in question has no members engaged as bricklayers or stonelayers in the Cities of Cork and Limerick; and, if so, if he is prepared to have an appeal board set up to review the decision.

I am aware that the Trade Union Tribunal has granted a determination to the Building Workers' Trade Union that that union shall have the sole right to organise bricklayers and stonelayers throughout the State. I have no information as to the membership of the trade union in question in Cork and Limerick. As regards the question of setting up an appeal board, I would refer the Deputy to Section 29 of the Trade Union Act, 1941, which sets out the conditions under which an appeal board may be set up to review a determination of the Trade Union Tribunal. I am not empowered to set up an appeal board on my own initiative.
