Written Answer. - Counsel in State Prosecutions.

asked the Minister for Finance if he will state, in respect of each of the years 1945 and 1946: (a) the junior, and (b) the senior counsel briefed in State prosecutions, or in State cases if the information for prosecutions is not compiled separately; the total fees paid or payable to each such counsel; also, in respect of each such counsel, the fees paid or payable in respect of: (i) original trials where the conviction was subsequently quashed on appeal; (ii) appeals resulting in the quashing of convictions, and (iii) retrials following such appeals; and further, the total sums paid, by way of costs, in each of the years mentioned, in respect of criminal proceedings where conviction was set aside on appeal, and the number of such appeals.

The information asked for by the Deputy is contained in the tabular statements which follow. It will be understood that a statistical approach does not provide a good basis for considering the results of appeals in criminal cases, and in particular it should be borne in mind that the duty of prosecuting counsel extends not further than to present the case for the consideration of the court.

NOTES

(1) The particulars relating to 1945 are subject to the notes to the tabular statement in cols. 891/92 of the Dáil Debates of 28th May, 1946.

(2) Fees paid to Counsel on original trials in 1946 include fees in one case (The People v. Henry White) where conviction for murder was quashed and conviction for manslaughter substituted.

(3) The figure for 1946 in column (6) includes the sum of £432 13s. 11d. being costs paid in a case in which the conviction was quashed in 1945. It does not include (a) the sum of £113 6s. 8d. paid in 1947 in a case in which the conviction was quashed in 1946, (b) the sum of £220 9s. 9d. in a case in which there was a retrial in 1946 and the costs have been taxed but not paid, the certificate of taxation not having been produced, or (c) the costs in a case in which the conviction was quashed in 1946 and a new trial ordered, the costs not having yet been furnished.
