Vol. 105 No. 14

Ceisteanna—Questions. Oral Answers. - Córas Iompair Éireann Regulations.

asked the Minister for Industry and Commerce if he will state the authority under which he approved, or declined to cancel, regulations made by Córas Iompair Éireann when purporting to act in the making of such regulations under authority of the Tramways Act, 1870; whether the Act mentioned has legislative effect in this country; if so, under what statutory instrument effect has been given to its provisions; and whether, if such regulations were made without lawful authority, he will cause public notice to be given that regulations, purporting to be made under the Act of 1870, are null and void.

I am advised that Sections 46 and 47 of the Tramways Act, 1870, were, by Section 4 of the Dublin United Tramways (Electrical Power) Act, 1897, applied to the then existing company which operated tramways in Dublin. Córas Iompair Éireann are the ultimate successors of that company.

I assume that the Deputy refers to the by-laws and regulations made by the company on 20th November, 1946. I am advised that these were made with lawful authority and I see no reason why they should be cancelled.
