Vol. 106 No. 17

Ceisteanna—Questions. Oral Answers. - Claremorris Farm.

asked the Minister for Lands if he will state if any further steps have been taken to acquire the non-residential farm situated at Carramarley, Claremorris, County Mayo, formerly the property of Luke Dillon and now owned by Mr. Clarke.

The Land Commission have considered the question of acquisition of the lands of Carramarley held by Mr. Francis Clarke and they have decided to take no action in the matter.

Can the Minister state why the Land Commission have decided to take no action in the matter?

There are certain regulations under which the Land Commission operate. They cannot acquire land which is being properly worked by the owner or they cannot acquire land except where a condition of acute congestion exists. Neither of these conditions exists in this particular case.

Does the Minister mean that acute congestion does not exist in this area? I can assure him it does.

May I further inquire as to whether the doctrine of fixity of tenure has become disreputable in this country or whether it is not legitimate to own your own land?

That is a separate question.

I am satisfied that there is no acute congestion in this particular district. I think a grave injustice would be done by the Land Commission acquiring this farm. I have already spoken on the question of fixity of tenure.

Is it not the policy of the Land Commission in districts where there are holdings under £10 valuation to acquire land where possible to bring these holdings at least up to £10 valuation?

Even where grabbing is necessary to achieve your purpose?
