Ceisteanna—Questions. Oral Answers. - Improvement of Drain from Cashel Lough.

asked the Minister for Finance if he will implement Section 49 of the Arterial Drainage Act, 1945, so as to have cleaning and deepening of the drain from Cashel Lough, through the townlands of Forkfield and Cappahaurnaun, electoral division of Aughagower, rural district of Westport, carried out under the rural improvements scheme.

I informed the Deputy on the 11th February, 1947, in reply to a question about the drain he refers to, that the work could not be proceeded with because of an objection by a land-holder that it would cause or aggravate flooding on his lands. My technical advisers report that this view is well founded; and, that being so, the objection cannot be regarded as unreasonable.

To enforce the provisions of Section 49 it is necessary to show, inter alia, that any objections made are unreasonable, and as this condition is not fulfilled in the present instance I do not propose to consider the case further.
