asked the Minister for Justice if he is aware that some officers in the County Registrar's office in Mayo are still unestablished although they are in the service for upwards of 40 years; and if he will take immediate steps to have these men made permanent with suitable pension rights.

I understand that the two officers in question did not avail of the offer of establishment made to them many years ago under the Court Officers Act, 1926. They are now both over the age of 60, whereas the rule is that nobody is established after he has reached the age of 50.

I may add that although not established they will be entitled to gratuities if and when they are discharged from service.

Will the Minister state what rule he refers to?

I have nothing to add.

Will the Minister state if these officers were prevented by some particular rule from being established? Is the Minister aware that he is entitled, under Section 62 (1) of the Court Officers Act, 1926, to have these officers established? Will the Minister state what rule he referred to in his reply which prevents him from having the officers established if over 50 years of age?

The two officers in question did not avail themselves of the offer to be established. Rules are rules, and if people will not accept what they are offered, what can you do with them?

Is there anything to prevent the Minister now from having these officers established if they desire to be established?

The Deputy should have asked that question at least a month ago.

I am asking it now.

This question affects officers employed in county registrars' offices all over the country.

This question relates to two officers in Mayo. The Deputy can put down a question for his own constituency if he thinks there are officers there in a similar position.

These two officers did not accept the offer.
