Ceisteanna—Questions. Oral Answers. - Allocation of Galway Estate.

asked the Minister for Lands if he will state whether the delay in preparing a scheme for the allocation of the resumed holding of F. and W. Burke, estate of Daly, Record No. S.3736, lands of Hillswood, County Galway, comprising, approximately, 61 statute acres, is caused by the refusal of the owners to give a right-of-way to the Land Commission; and, if so, what steps are being taken to overcome this difficulty in order to ensure that a scheme of allocation will be put into operation this year.

The resumption proceedings in this case have not yet been completed. The Land Commission have adequate powers to acquire any right-of-way that may be required for the allotment of the lands.

Is the Minister aware that this particular case has been going on for a long number of years; that the Land Commission overruled the objection of the owner in 1941; and, as we have acute congestion in the adjoining districts, why it is that such undue delay has taken place?

The Land Commission are acquiring a right-of-way which they understood, when acquiring other portions of these lands, would be granted without any trouble. I understand that the owner of the portion of land retained is raising objection to the acquisition of the right-of-way without which these lands cannot be allotted.
