Vol. 123 No. 6

Ceisteanna—Questions. Oral Answers. - Land Acquisition.

asked the Minister for Lands if he will state the present position as regards the acquisition by the Land Commission of the farm of Thomas Dunleavy, Carnacross, Ballyvary, County Mayo.

The proceedings in this case are held up pending a decision on a question of law.

Is the Minister not aware that proceedings have been held up in this case for almost 18 months, that on two separate occasions the party concerned—Mr. Dunleavy—was brought before the Appeal Tribunal, and that despite the fact that Land Commission officials were brought from the County Mayo to Dublin there was no sitting of the tribunal held. Can the Minister state the reason why?

I cannot. That is a matter beyond my control.

Would the Minister take steps to speed up the matter and have a decision one way or the other?

I understand that this case is locked up with another High Court case which is pretty similar to it. I believe that until this other case has been disposed of this one cannot be taken.

Can the Minister say how often sittings of the tribunal are held?

That is a separate question.

asked the Minister for Lands if he will state whether the Land Commission have considered the propriety of acquiring the lands known as the McKeever estate, now Donaghy, in the townland of Summerhill, Upper Ardee, County Meath; and, if so, with what result.

The Land Commission have not considered the question of acquiring these lands.
