Ceisteanna—Questions. Oral Answers. - Military Service Pensions Acts.

Mr. Byrne

asked the Minister for Defence if he proposes to introduce proposals to amend the Military Service Pensions Acts, 1934 and 1949, so as to give a broader, simpler and clearer definition of active service, and to have consideration given to a wider range of cases which, up to the present, are known as border-line applications.

I do not propose to introduce proposals as suggested by the Deputy. The term "active service" has not been defined in the Military Service Pensions Act, 1934, or in the Military Sendee Pensions Act, 1949. The interpretation of the term is a matter solely within the jurisdiction of the Referee appointed under the Act of 1934. Each case is decided on the facts having regard to the requirements of Section 3 (1) and (2) of that Act.
