Ceisteanna—Questions. Oral Answers. - Garda Retirement Payments.

asked the Minister for Justice if he is aware that certain members of the Garda Síochána who are entitled under regulations to opt for a lump sum payment on retirement in lieu of pension have been precluded from so doing because of illness contracted during their period of service, and if he will amend the regulations to remedy this situation.

The matter referred to was carefully considered when the Garda Síochána Pensions Order, 1951, was being made and it was decided that the health test as prescribed by the Order could not be waived. It is not proposed to amend the relevant provision in the Order as suggested by the Deputy.

asked the Minister for Justice if he is aware that a member of the Garda Síochána may be required to pay more than the required 30 year payments which entitle him to a pension if he has not reached pensionable age after such payments have been made and if he will amend the regulations to remedy this situation.

I am not prepared to amend the regulations so as to provide that pension deductions will cease when members of the Garda Síochána have completed 30 years' service.
