Vol. 138 No. 7

Ceisteanna—Questions. Oral Answers. - Rent Restrictions Act, 1946.

asked the Minister for Justice if he is aware that under a recent decision of the Supreme Court it has been laid down that on the death of a contractual tenant there is no provision to secure his widow or children against eviction and if he will take immediate steps to rectify this omission from the Rent Restrictions Act, 1946.

I am aware of the judgment referred to by the Deputy.

The question of strengthening the protection to be given to the widow or children of a deceased contractual tenant is being examined in conjunction with the report on rent control presented by the Rents and Leaseholds Commission, some of whose recommendations are concerned with this matter. Pending completion of this examination, I do not propose to introduce legislation dealing with particular aspects of the rent restrictions law.
