Restrictive Trade Practices Bill, 1952—From the Seanad.

In regard to these amendments inserted by the Seanad, all of which are more or less of a minor character, I am asking the Dáil to agree with them.

The Dáil went into Committee to consider amendments inserted by the Seanad.

I move that the Committee agree with the Seanad in amendment No. 1:—

In page 3, Section 7, sub-section (1), lines 5 and 6, "(by one or more of their members delegated by them for the purpose)" deleted and before sub-section (2) the following inserted:—

(2) Subject to sub-sections (3) and (4), an inquiry may be held by one or more of the members of the commission delegated by the commission for the purpose.

(3) An inquiry shall not, without the consent of the Minister, be held by a temporary member, acting alone.

(4) Not more than one temporary member may act for the purpose of a particular inquiry.

The Bill provides that the commission may hold a public inquiry by one of its members. The effect of this amendment is to provide that the member holding the inquiry may not be a temporary member, without the consent of the Minister.

I move that the Committee agree with the Seanad in amendment No. 2:—

In page 4, Section 9, sub-section (1), paragraph (f), line 19, after "in regard to" the words "restrictive practices affecting" inserted.

This is of a drafting character, intended to clear up certain doubts in the wording of a paragraph.

Amendment agreed to.

I move that the Committee agree with the Seanad in amendment No. 3:—

In page 6, First Schedule, paragraph 1, sub-paragraph (3), line 22, before "temporary" the word "additional" inserted and in lines 22 to 24 from the word "Not" to the word "inquiry" deleted.

This is a drafting amendment only. It is a rearrangement of the section.

I move that the Committee agree with the Seanad in amendment No. 4:—

In page 7, First Schedule, paragraph 5, sub-paragraph (1), line 15, after "two" the words "permanent members" inserted

The Bill provided that two members of the commission would constitute a quorum. The effect of this amendment is to require that it be two permanent members.
