Ceisteanna—Questions. Oral Answers. - Donegal Estate Fencing.

asked the Minister for Lands if he will state the present position in regard to the erection of a fence, starting at octerlinn Chapel, Rathmullan, and ending at Croghan, between the Batts and Fenton estates, County Donegal.

The Batt and Fenton estates have both been vested in the tenants for many years and the Land Commission are not prepared to undertake the construction of the fence described by the Deputy.

Would it be too much to expect the commission to have given that reply to the representations made to them about six months ago, or do we have to wait for a year?

The Deputy made representations some time prior to June last and was informed then that they were not prepared to undertake the fencing.

What is the difference now?

For the Deputy's information, I might point out to him that one of those estates was vested in 1902 and the other in 1925. The Land Commission has no responsibility for land once the ownership is vested in the tenant. This is the first time that this has been raised and it is a strange thing——

I am afraid the Minister has misunderstood. I made representations which eventually reached the Land Commission upwards of six or eight months ago. Now I find this is a matter which they cannot deal with.

The Deputy got a written reply from the Land Commission on the 11th July last stating that the Land Commission—in reply to his representations—were not prepared to undertake the fencing.

Well the letter went out to the Deputy and I presume he received it.
