Ceisteanna—Questions. Oral Answers. - Local Authorities (Works) Act.

asked the Minister for Local Government if he is aware that levies by the Cork County Council on the urban areas of Cobh, Midleton, Youghal and Fermoy for the years 1948-49, 1949-50, 1951-52, 1952-53 and 1953-54 in respect of work carried out under the Local Authorities (Works) Act, 1949, being the difference between receipts and expenditure under the Act during these years, have not been refunded to these councils despite guarantees given in the Dáil by the Minister's predecessor in reply to questions on 15th July, 1952, and, if so, whether he will state the reasons for the delay in repayment, and when these moneys will be refunded to them.

I am not aware that levies by the Cork County Council on the urban areas of Cobh, Midleton, Youghal and Fermoy in respect of works carried out under the Local Authorities (Works) Act, 1949, for the financial years 1948-49 to 1953-54 inclusive have not been adjusted in favour of the respective urban authorities. From inquiries made, I am satisfied that, in the demands made by the county council in 1953-54, full credit was given to the urban authorities to rectify any apportionments which may not have been taken into account when the Deputy raised the question on 15th July, 1952. Adjustments of such amounts are effected by giving credits in the prescribed demands and no refunds are directly payable to the urban authorities in respect thereof.

asked the Minister for Local Government if he will state, in respect of each financial year from, and including 1949-50, (a) the total amounts demanded by the Cork County Council from the Cobh, Midleton, Youghal and Fermoy urban district councils in respect of schemes under the Local Authorities (Works) Act, 1949, (b) the amounts recouped to each urban district council, and (c) the total loss incurred by each urban district council in respect of such works.

The information sought by the Deputy is not available in my Department.

asked the Minister for Local Government whether he is aware that the Cobh, Midleton, Youghal and Fermoy Urban District Councils implement, out of their own funds, their own schemes under the Local Authorities (Works) Act, 1949, and, if so, if he will take steps to prevent the urban ratepayers from being levied by the county council in respect of such schemes.

I would refer the Deputy to the provisions of Section 47 of the Local Government Bill, 1954, as passed by Dáil Eireann.
