Vol. 150 No. 12

Ceisteanna — Questions. Oral Answers. - City Manager's Term of Office.

asked the Minister for Local Government whether, following the passing of the Local Government (Amendment) Act, 1955, he has made an Order extending the employment of the Waterford City Manager, and, if so, for what period.

The Local Government Act, 1955, does not provide for the making of any Order of the nature referred to by the Deputy and I have made no such Order.

asked the Minister for Local Government when the Waterford City Manager will cease to hold his present position.

The Waterford City Manager has a statutory tenure of office until he dies, resigns or is removed from office. Notwithstanding this tenure Section 24 of the Local Government Act, 1955, authorises the Minister to make a declaration under Section 23 of the Local Government Act, 1941, fixing an age limit in relation to the office of Waterford City Manager and any such declaration would come into force six months after the day on which it is made. No such declaration has been made by me in relation to this office.

Has the Minister any intention of making such a declaration?

I will communicate with the Deputy when I make it.

I take it the Minister will remember in making such a declaration, that the Waterford City Manager has given long and honourable service to this country?

All relevant matters will be taken into consideration when I come to make the declaration.
