Ceisteanna—Questions. Oral Answers. - Garda Witnesses in Border Area.

asked the Minister for Justice whether he is aware that two members of the Garda Síochána gave evidence recently at Crossmaglen Petty Sessions in a case in which a forfeiture order was made in respect of a motor lorry; and, if so, if he will state (a) by whom the expenses of the Gardaí concerned were paid for attending the court, (b) whether he gave authority for this action on the part of these men and (c) whether similar action on the part of the Garda Síochána is contemplated in all such cases in the future.

Two members of the Garda Síochána gave evidence as stated in the question. The members attended the court in accordance with long-standing reciprocal arrangements whereby officials on both sides of the Border cooperate in the prevention of illicit Border traffic, both by the exchange of information and the giving of evidence in court. I have no reason to think that any change in these reciprocal arrangements is contemplated and, as long as they remain in operation, the Garda Síochána will continue to act on the same basis as other State officials such as customs officials. No expenses were incurred in the case referred to, transport having been provided by the Six County customs.

Will the Minister state that this reciprocal arrangement applies in all such cases and whether or not the particular case in question was one in which there was discrimination?

I have no reason to believe that.

Does the Minister tell the House now that in all similar cases the Garda Síochána take similar steps?

For the prevention of illicit traffic of that kind, yes.
