Vol. 179 No. 7

Written Answers. - Malicious Injuries Acts.

77.

asked the Minister for Local Government if he will state in respect of each county council and each county borough council, including the Borough of Dún Laoghaire as regards the Malicious Injuries Acts (1) the amounts raised by local rates in each case in a recent year and the total amount of money raised and (2) the rate in the pound for malicious injuries charges.

It is not possible to furnish information in the form requested by the Deputy. Compensation in respect of malicious injuries is payable by county councils and county borough corporations. In the case of county councils, charges for malicious injuries are not included in the general rate. Such charges are raised by means of a special rate which is levied over the county-at-large or such lesser area as the Circuit Court may determine.

The expenditure of county councils and county borough corporations in respect of compensation for malicious injuries in the year 1958/59 was as follows:—

NOTES.

(1) These figures are subject to review at audit.

(2) Borough corporations are not required to pay compensation in respect of malicious injuries. They must, however, contribute to the council of the county in which they are situated their portion of any amount levied on an area of which the borough forms a part and the whole of any amount levied exclusively on the area of the borough. Thus in the year 1958-59 Dún Laoghaire Borough Corporation contributed £293 to Dublin County Council in respect of malicious injuries.
