asked the Minister for Justice if he is prepared to instruct the Garda Síochána to prosecute in cases where loud speakers used from moving vehicles create a public nuisance.

I do not propose to issue instructions on the lines suggested. It appears to be open to local authorities, under Section 125 of the Municipal Corporations (Ireland) Act, 1840, and Section 16 of the Local Government (Ireland) Act, 1898, to make byelaws to regulate the use of loudspeakers which may be a public nuisance. In the absence of such byelaws, I do not consider that intervention by the Garda Síochána would be appropriate or advisable.

Is the Parliamentary Secretary aware that it is an offence to put posters on lamp posts and that in Finglas they are plastered with Fianna Fáil posters? As one Deputy is complaining about another offence, I might as well mention this one.

In reply to the Deputy, may I point out that Fianna Fáil are by no means the worst offenders in that respect?
