asked the Minister for Local Government if he is aware that certain county managers are not permitting Section 45 of the Local Government (Superannuation) Act, 1956, to operate by dismissing workmen who obtained re-employment, having previously withdrawn contributions under Section 44; and if he will take steps to rectify the matter.

I am not so aware. The recruitment and dismissal of its employees is a matter for each local authority and is one in which I have no function.

asked the Minister for Local Government if the members of a local authority may, under the City and County Management Act, 1955, direct a county manager not to dismiss workmen who may, on reemployment, be entitled to the option in Section 45 of the Local Government (Superannuation) Act, 1956, being workmen who are likely to be dismissed drawn contribution under Section 44. and who are likely to be dismissed because, and only because, they had exercised an option under Section 44.

The members of a local authority may not so direct. The recruitment and dismissal of employees of a local authority is an executive function of the county manager and is specifically excluded from the matters concerning which a Council can requisition a manager under Section 4 of the City and County Management (Amendment) Act, 1955.
