asked the Minister for Finance whether it is the invariable rule of the Civil Service Commissioners that a person who has once failed the medical examination necessary for entry into an established position in the Civil Service is permanently debarred, regardless of the extent to which his health may improve, from establishment in the Civil Service; and, if so, whether he will consider taking steps to have this rule made more flexible, particularly in the case of persons who have over a long period of time been employed in unestablished positions in the service and are debarred from establishment only because they were suffering from temporary ill-health, from which they have now completely recovered, at the time of their original medical examination.

A person who has been rejected by the Civil Service Commissioners on medical grounds is not debarred from appointment to an established position (a) if he subsequently competes successfully for an established position and (b) if his health has sufficiently improved to enable him to satisfy the medical requirements.
