asked the Minister for Defence the reasons why an old IRA pension was temporarily abated and a special disability allowance discontinued in the case of a permanently incapacitated man (name supplied); and if he will have the case reviewed in view of the extenuating circumstances and the national record of the person concerned.

Whilst his special allowance was under annual review in November, 1961, it came to light that the person to whom the Deputy refers had a portion of his land let for several years, which fact he had not previously disclosed. He was accordingly in receipt of a special allowance at a rate in excess of his entitlement during those years and an overpayment of £82 5s. 5d. occurred. By withholding his special allowance entitlement and military service pension, the overpayment will be recovered by the end of December, 1962 and payment will then be resumed.

In cases where there has been a deliberate concealment of means, recovery of the amount overpaid cannot be foregone.
