Mr. Donnellan

asked the Minister for Lands whether he is aware that congested tenants in the Termon area of Gort, County Galway, made representations some time ago to the Land Commission to acquire and divide lands in the area; that those lands were subsequently offered for sale; and that the tenants in question understood that the Land Commission were represented at the sale and purchased the lands; if they were represented at the sale; if not, why; and, if they were represented, whether they bid for and bought the lands.

The Land Commission received representations about this 40 acre holding which went to public auction shortly afterwards. The Land Commission were not represented at the auction as the lands were not clearly within the relevant provisions of the Land Act, 1950.

Acquisition proceedings were subsequently instituted but the owner's objection was allowed by the Commissioners at a public hearing last month.

The Minister could not do anything in that case?

No. The Land Commission took acquisition proceedings but, as I said, the court ruled against the Land Commission in the matter.
