asked the Minister for Justice the total amount collected in fees during each of the last ten financial years in (a) the Land Registry and (b) the Registry of Deeds, stating in each case the number of dealings involved and the average fee per dealing.

The answer is in the form of a tabular statement which with your permission, a Cheann Comhairle, I propose to circulate with the Official Report.

In connection with the information given in the tabular statement, I should like to point out that, strictly speaking, there is no such thing as a "dealing" in the Registry of Deeds. The Registry of Deeds merely records the existence of deeds and conveyances which fall to be privately examined and interpreted by any person investigating the title to land. Registration in this instance consists simply of the lodgment and recording of documents. The Land Registry, on the other hand, registers the effect of documents following on examination of the title and of the documents by officials of the Registry and this registration constitutes an authoritative record of title which is guaranteed by the State.

2. The difference between the figures in Column (2) and those in Column (3) represents fees received in respect of transacting other than Dealings.

3. Columns (3), (4) and (5) relate only to Dealings in respect of which fees are chargeable.

4. "Dealings" in this context mean operations on land already registered.

2. The difference between the figures in Column (2) and those in Column (3) represents the amount collected in respect of fees for Common Searches, Vacates of Building Mortages and Satisfactions of Judgement Mortgages, etc.

3. The figures given in Column (4) represent only those Deeds for the Registration of which a charge is made.
