asked the Minister for Justice whether he intends to take steps to amend the law which requires the Garda to take court proceedings against a person who has attempted suicide.

The Programme of Law Reform envisages a general review of the various branches of the criminal law and the enactment of comprehensive legislation to replace the present provisions. In the course of the review, the particular aspect referred to by the Deputy will come up for consideration.

Is it mandatory on the Garda to take action in these cases or may they use their discretion?

The only comment I can make on that is that action is not taken in all cases.
