Financial Resolutions. - Financial Resolution No. 7: Customs and Excise—Hydrocarbon Oils.

I move:

(1) That in this Resolution—

"the Act of 1935" means the Finance Act, 1935 (No. 28 of 1935); "the (No. 69) Order" means the Imposition of Duties (No. 69) (Hydrocarbon Oils) (Excise Duties) Order, 1959 (S.I. No. 104 of 1959); "the (No. 84) Order" means the Imposition of Duties (No. 84) (Hydrocarbon Oils) (Customs Duties) Order, 1959 (S.I. No. 219 of 1959).

(2) That the duty of customs imposed by section 1 of the Finance (Customs Duties) (No. 4) Act, 1931 (No. 43 of 1931), as amended by subsequent enactments, shall, in respect of mineral hydrocarbon light oil chargeable with that duty, be charged, levied and paid as on and from the 15th day of April, 1964, at the rate of 3s. 1?d. the gallon in lieu of the rate specified in paragraph 3 of the (No. 84) Order.

(3) That the duty of excise imposed by section 1 of the Finance (Miscellaneous Provisions) Act, 1935 (No. 7 of 1935), as amended by subsequent enactments, shall, in respect of mineral hydrocarbon light oil chargeable with that duty which is sent out, on or for sale or otherwise, from the premises of the manufacturer thereof on or after the 15th day of April, 1964, or is used by such manufacturer on or after that date for any purpose other than the manufacture or production of mineral hydrocarbon oil, be charged, levied and paid at the rate of 3s. 0?d. the gallon in lieu of the rate specified in paragraph 2 of the (No. 69) Order.

(4) That the duty of customs imposed by section 21 of the Act of 1935 shall, in respect of hydrocarbon oil chargeable with that duty, be charged, levied and paid, as on and from the 15th day of April, 1964, at the rate of 2s. 5 1/12d. the gallon in lieu of the rate now chargeable by virtue of paragraph 4 of the (No. 84) Order.

(5) That as on and from the 15th day of April, 1964, the rate of any rebate allowed under subsection (2) of section 21 of the Act of 1935 shall—

(a) in respect of hydrocarbon oil on which such rebate is allowable and on which the duty of customs mentioned in paragraph (4) of this Resolution was paid at the rate of 2s. 5 11/12d. the gallon, be 2s. 5 11/12d. the gallon, and

(b) in respect of hydrocarbon oil on which such rebate is allowable and on which the duty of customs mentioned in paragraph (4) of this Resolution was, by virtue of paragraph 6 of the (No. 84) Order, paid at the rate of 2s. 411/12d. the gallon, be 2s. 411/12d. the gallon,

in lieu of the rate allowable immediately before the 15th day of April, 1964, by virtue of subsection (2) of section 18 of the Finance Act, 1960 (No. 19 of 1960).

(6) That the duty of excise imposed by section 21 of the Act of 1935 shall, in respect of hydrocarbon oil chargeable with that duty which is sent out, on or for sale or otherwise, from the premises of the manufacturer thereof on or after the 15th day of April, 1964, or is used by such manufacturer on or after that date for any purpose other than the manufacture or production of hydrocarbon oil, be charged, levied and paid at the rate of 2s. 411/12d. the gallon in lieu of the rate now chargeable by virtue of paragraph 3 of the (No. 69) Order.

(7) That as on and from the 15th day of April, 1964, the rate of any rebate allowed under subsection (4) of section 21 of the Act of 1935, in respect of hydrocarbon oil on which such rebate is allowable and on which the excise duty mentioned in paragraph (6) of this Resolution was paid at the rate of 2s. 411/12d. the gallon, shall be 2s. 411/12d. the gallon in lieu of the rate allowable immediately before the 15th day of April, 1964, by virtue of subsection (3) of section 18 of the Finance Act, 1960.

(8) That as on and from the 15th day of April, 1964, the rate of any repayment allowed under sub-section (8) of section 10 of the Finance Act, 1957 (No. 20 of 1957), in respect of hydrocarbon oil on which such repayment is allowable and on which either—

(a) the excise duty mentioned in paragraph (6) of this Resolution was paid at the rate of 2s. 411/12d. the gallon, or

(b) the customs duty mentioned in paragraph (4) of this Resolution was paid at the rate of 2s. 411/12d. the gallon or 2s. 511/12d. the gallon,

shall be 9d. the gallon in lieu of the rate allowable immediately before the 15th day of April, 1964.

(9) It is hereby declared that it is expedient in the public interest that this Resolution shall have statutory effect under the provisions of the Provisional Collection of Taxes Act, 1927 (No. 7 of 1927).

As I understand the Budget speech, this Resolution provides (a), that the price of petrol will be increased; (b), that the price of diesel oil, which is used in all road transport, will be increased; and (c) that there will be a rebate in respect of diesel oil used in buses.

That is right.

What happens to diesel oil used in agricultural tractors? Do farmers get a rebate or will they pay the additional cost?

I understand diesel oil is free of the tax, outside of road transport.

What about lorries? Will the increase be payable in respect of lorries?

They are paying at the moment. They will pay threepence more.

Will all commercial vehicles pay?

I should like to inquire just what the actual connotation of the Minister's proposal here is. It is proposed to increase the price of petrol and oil by 3d a gallon. Many thousands of people in towns and throughout the country use autocycles and such vehicles to get to and from work. They use a mixture of oil and petrol. I take it this increase will apply to that type of fuel?

Is there an exemption for hire buses, for buses used by hotels for tourist purposes?

Yes, in cases of passenger transport. They are exempt in respect of diesel but not petrol.
