asked the Minister for Local Government why Cement Limited were allowed to erect metal containers at Cabra station, in spite of the fact that building permission had been refused by Dublin Corporation.

In the interim period prior to the coming into operation of a planning scheme under the Town and Regional Planning Acts, 1934 and 1939, the planning authority had no effective powers to prevent the erection of structures for which permission had not been granted or to secure their removal, when erected. The powers now available under the Local Government (Planning and Development) Act, 1963, enable proceedings to be taken for the removal or alteration of any unauthorised structures such as those referred to by the Deputy. It is a matter for Dublin Corporation in the first instance to consider what action should be taken in regard to these structures.
