Mr. Barrett

asked the Minister for Justice if he will state the date upon which and the manner in which the Government delegated him their power to commute or remit punishment by a court exercising criminal jurisdiction.

On 30th March, 1951, the Government, in exercise of the power conferred by subsection (3) of section 23 of the Criminal Justice Act, 1951, formally delegated to the Minister for Justice their powers, to commute or remit, in whole or in part, any punishment imposed by a court exercising criminal jurisdiction, subject to such conditions as the Minister may think proper.

The Government's decision was published in Irish Oifigiúil on 6th April, 1951.

Mr. Barrett

asked the Minister for Justice if he will give details of the number of cases in which punishment imposed by courts exercising criminal jurisdiction has been commuted or remitted during the past 12 months together with details of (a) the extent of the original sentence, (b) the extent of the time served or to be served as a result of his decision to commute or remit such sentences, and (c) the criminal charges involved in each case.

Apart from the cases of 35 prisoners who were released in pursuance of the annual Christmas amnesty, and 45 releases on the occasion of the amnesty given on the elevation of Most Rev. Doctor Conway to the College of Cardinals in February, 1965, which were exceptional, the particulars asked for by the Deputy for the twelve months ended 30th April, 1965, will be given with your permission, a Cheann Comhairle, in a tabular statement which will be circulated with the Official Report.
