asked the Minister for Transport and Power if he is aware of the continuing injustice by which the ESB confiscate land for the erection of poles and pylons; and while allowing the ESB have a right of passage, if he will take such steps as are necessary to provide that the farmer should be paid adequate compensation for the land occupied by these poles and pylons.

The erection by the Electricity Supply Board of poles and pylons on private property is governed by section 53 of the Electricity (Supply) Act, 1927 as amended by section 4 of the Electricity (Supply) (Amendment) Act, 1935 and section 46 of the Electricity (Supply) (Amendment) Act, 1945. No compensation is payable to landowners under the statutes, but I am informed by the Board that, in some cases, where there has been substantial interference with land, they make ex gratia payments. Amending legislation on this subject is not contemplated.
