Vol. 218 No. 5

Ceisteanna—Questions. Oral Answers. - Local Government Act.

8.

asked the Minister for Local Government if subsection (1) of section 57 of the Local Government Act, 1955 standing by itself confers powers on the elected members of local authorities to decide, by resolution, to make a contribution for the purposes of that section.

If subsection (1) of section 57 stood alone, a decision to make a contribution would not be a reserved function. Subsection (2), however, provides that the making of contributions or the granting of assistance under the section shall be a reserved function.

Surely the Minister will not in future quote subsection (1) as being the correct provision?

I am not aware I have been quoting.

I could give the Minister half a dozen instances. It sounded quite nice the way the Minister said it.

In what context?

The context is there.

I do not agree.
