asked the Minister for Justice if his attention has been drawn to the recent statements at sittings of the Circuit Court in the county of Leitrim by the Circuit Judge regarding the difficulties experienced in that court occasioned by the failure to obtain certificates of death; and if he is prepared to amend section 52 of the Local Registration of Title (Ireland) Act, 1891, so as to facilitate the granting of orders under that section where certificates of death are not available.

I cannot accept the case made for the amendment proposed. I am informed that out of 65 applications made to the court in County Leitrim under section 52 of the 1891 Act in the period from 1st August, 1964, none was refused for want of a death certificate. The position in law is that the form of proof necessary to establish title under the section in any particular case is left to the court and I am satisfied that this position should not be disturbed.
