Mr. O'Leary

asked the Minister for Local Government if he will state the circumstances under which a public thoroughfare, Dorset Row, Dublin, was closed to public traffic; and if he will indicate how a private firm (name supplied) secured permission to seal off this thoroughfare.

Mr. O'Leary

asked the Minister for Local Government if he will indicate the agency or department of Dublin Corporation responsible for cutting off the public lighting system in Dorset Row, Dublin.

With your permission, a Cheann Comhairle, I propose to take Questions Nos. 16 and 17 together.

I understand that the operations referred to by the Deputy in his questions were carried out pursuant to powers vested in Dublin Corporation under section 45 of the Dublin Corporation Act, 1890.

Is the Parliamentary Secretary aware that this thoroughfare was used as a right of way by householders in the area and is he informing me now that Dublin Corporation have closed it down? Did they consult with the householders?

I understand it has been closed down as a public thoroughfare.

Mr. O'Leary

Does the Parliamentary Secretary appreciate that this public thoroughfare has been closed down at either end and that people cannot drive their cars through it?

I understand the Corporation have made the necessary provisions under the Act.

They cannot do so without getting the permission of the Department.

I understand they have the right under section 45 of the Dublin Corporation Act.

With the permission of the Minister for Local Government.

Have the Department given permission for a public thoroughfare leading on to Dorset Street, an important shopping centre, to be closed down? It is extraordinary that a private concern, Lister Engineering Co., can close down a public thoroughfare.

In this case the Corporation did not have to apply to the Department.
