asked the Minister for Industry and Commerce if he will state, having regard to the fact that many employees of insurance companies engaged in collecting weekly premiums have not yet been granted holidays with pay, what steps he will take to ensure that such employees are granted their statutory holidays with pay without further delay.

I assume the Deputy is referring to insurance agents employed under what is known as a contract for services. The position is that such agents were brought within the scope of the Holidays (Employees) Act, 1961, by regulations made in 1963. A particular insurance company contested the power to bring agents employed under a contract for services within the scope of the Act.

I have taken a test case against the company in the District Court and the Justice decided to state a consultative case for the High Court. I am awaiting the result.

The Minister would not like to anticipate when we will get it?
