asked the Minister for Defence whether he has any evidence which would suggest that high altitude aircraft frequently use Irish air space; and whether any formal arrangement exists which allows British aircraft to use Irish airspace.

In response to requests received from time to time from the Governments concerned — including the British Government — the Department of External Affairs, after consultation with my Department and the Department of Transport and Power, grants permission for the overflying of Irish territory by foreign military aircraft. The incidence of such overflights is fairly frequent.

The granting of such permission is in accordance with the Air Navigation (Foreign Military Aircraft) Order, 1952 which provides, inter alia, that no foreign military aircraft shall fly over or land in the State save on the express invitation or with the express permission of the Minister for External Affairs.

I have no evidence which would suggest that high altitude military aircraft of foreign countries use Irish air space other than in accordance with the procedure I have outlined.

Can the Minister tell us if it is a fact that, as is generally rumoured, our fugitive diplomat overflies this country regularly? Does he apply for permission?

That does not arise.
