Vol. 231 No. 10

Ceisteanna—Questions. Oral Answers. - Suing of Barristers.

37.

asked the Minister for Justice why barristers cannot be sued for negligence; and if he will consider taking steps to abolish this privilege which is not enjoyed by the members of any other profession.

The law on this subject has never been finally determined in this country.

In February, 1965, I asked the Committee on Court Practice and Procedure to examine the organisation of the legal profession in this country and to enquire into any professional practices that may tend to make litigation unduly expensive and less efficiently conducted. In this connection, I would expect that the Committee would consider the so-called immunity rule for barristers. However, I shall now ask them to give particular consideration to it.

Question No. 38 withdrawn.
